Insult (in Austrian law: Ehrenbeleidigung): under Section 115 of 
the Austrian Penal Code, verbal abuse, mocking and physical 
mal-treatment only prosecuted upon application of the injured party 
(within a period of 6 weeks); these offences are only punishable by a 
court sentence if they are committed publicly or in the presence of at 
least three persons. In the absence of such publicity, provincial 
legislation of some provinces classifies such offences as only 
punishable under administrative law (trespass to a person´s 
honour). If the insult results in a property tort, the victim can sue 
the offender for damages.
