Detention, Provisional, law enforcement agents may arrest for a 
maximum of 48 hours persons suspected of committing, or about to 
commit a crime, persons caught in the act of committing a crime, in 
danger of committing a crime or by court order, provided grounds for 
arrest are present (no valid identification, danger of flight, danger 
of committing a crime) (§ 35 Administrative Penal Law, 
§ 177 Rules of Criminal Procedure). The arrested party is to 
be questioned within the given period of time. In the case of any 
actions punishable by a court of law, a ruling on whether to take the 
arrested person into pre-trial custody must be made within 48 hours 
after presentation to the court.
