Home Workers: According to section 2 subsection 1 of the
Home Working Act 1961 (Federal Law Gazette 1961/105,
Heimarbeitsgesetz) home workers are persons manufacturing, processing
or packaging goods in their own home or at any other place of work
chosen by themselves, by order and for the account of their employers
and without carrying on a trade. The law also covers intermediaries,
i.e. persons carrying on a trade and working for their employer under
the same conditions as home workers. They are held equal to home
workers unless they employ more than 2 workers they are not related
to. Because their status is generally similar to that of regular
employees, the Home Working Act provides for standardised regulations
for the protection of employees. Both home workers and intermediaries
are entitled to pay for work done on a holiday, paid vacation, time
off work for the care of a sick relative and continued remuneration in
case of sickness, etc. Termination of employment is subject to certain
periods of notice. Home workers are also entitled to compensation for
dismissal in accordance with the employees' act.
