Defence, Counsel for the, legal adviser of the accused in criminal 
proceedings. There are lists of counsels for the defence at each 
Oberlandesgericht, only qualified lawyers (Anwaelte) may enrol. Legal 
defence is required during  Pretrial Detention, during trial for 
offences under a penalty of 3 years imprisonment, during trial in 
appellate procedure, when lodging a plea of nullity, if the accused is 
detained in an institution for abnormal law-breakers or in a centre 
for drug addicts, if the accused is a young person during the entire 
proceeding before a higher court of justice and in some cases also 
before a district court. In cases of indigence, the state offers the 
free services of ex officio counsel.
