commercial purposes, provided that such use does not constitute a public administrative
activity. To the contrary and in a negative sense, re-use does not constitute an
administrative activity (according to an enabling title and in accordance with a
regulated procedure), nor can it be confused with the exchange of documents between
Public Administrations in the exercise of their functions attributed.
The administrative regime of the reuse includes the formats available for reuse, the
prohibition of exclusive rights, the application of tariffs, the conditions of reuse, the
licenses, the application procedure and the sanctioning regime. Finally, it can not be
mentioned that Spain has obtained the highest score for the European Data Portal in the
second Assessment Report on the Maturity Level of the Open Data Ecosystem.
4.- Provision of public services in smart destinations
A.- Public services 4.0
The incorporation of technical means to the provision of services implies not only
unquestionable advantages in terms of effectiveness and efficiency (remote readings of
drinking water meters, programs for detecting leaks in the network, forecasting of
capacity and arrival of public transport vehicles, availability of parking spaces, predict
the risk of fire in buildings or floods, identify the premises that will be subject to
inspection ...), but a radical transformation of the service provider Administration
model.
Until recently, the administrative activity of the service, that is to say, the rendering of
public services (including the giving of goods to the market) rested on the evaluation of
public policies. However, the classic processes of improving the quality of services are
insufficient, so that it is not enough today to evaluate whether the service is provided in
accordance with the expectations of the citizen.
Hence, in consequence and in parallel to the so-called Industry 4.0, in the countries of
our environment appeal to Public Services 4.0 to refer to an Administration that adapts
its operation to the citizen's demand.
This form of providing services is based on technology, which allows public entities to
individually identify citizens who may demand public service. This information is
possible thanks to intelligent systems based on algorithms, which collect and interpret
data and make automated decisions.
With the macro data and internet of things techniques, the Administration has
information that allows a proactive approach to the provision of the service, as well as
an individualization of the demand. Think, for example, of urban public transport,
which - instead of frequencies organized by linear shifts and without distinction - can
be adapted according to the demand in each place and at the moment in existence. The
same can be said about the collection of waste, which can also vary depending on times
of greater influx or not of residents in urban areas, or visitors in tourist areas.
