To a greater extent, and already connecting access with reuse, the information that was
initially generated in a certain context can be used for purposes other than those for
which the data was collected, with the participation of actors that can be moved by
interests chrematistic and not for the general interest.
At this point there is a divergence between the legal regime, which is still dictated on
the basis of consent, and the unstoppable reality, which accesses the data to give them a
different use, sometimes commercializing the information obtained based on the right
of access. Such is the case of the Judgment of the Court of Justice of the European
Union of October 16, 2016 (case C-582/2014), which qualifies as personal data for the
website manager, the dynamic Internet protocol address of a user, when said manager
(in the case, public) has legal means to identify the user thanks to the supplementary
information available to the user's Internet access provider.
IV.- CONCLUSIONS
In the 21st century, public policies are not understood apart from intelligent
governance, which invariably rests principally on technology. In this sense, smart
governance is based on the interaction between the Administration, citizens and the
business sector, in a race towards greater levels of efficiency, transparency,
accountability and trust in the public sector.
It is evident that in recent years there has been a notable advance in the use of technical
means in the administrative procedure. However, and in view of its undoubted
advantages, it is no less true that, from a legal point of view, the volume of data, the
need to guarantee its quality, updating and interoperability, constitute some of the
challenges to which the management systems of the information of the Public
Administrations must give answer.
In the access and reuse of tourist data, the quality of the democratic system and the
effectiveness and efficiency of the public authorities demand an increase in
transparency, the personalization of the rendering of services, the optimization of the
management of resources, automation of decision-making and, in general, higher levels
of innovation.
None of this can be done outside the administrative intervention in its role of ensuring
computer security and compliance with the guarantees required in terms of privacy.
