Provincial Government, highest administrative authority in the provinces (collegial body). The provincial government consists of the Landeshauptmann, his deputy/-ies and other members (usually 7-9, number is fixed in the provincial constitutions). In Vienna, the City Senate is at the same time the provincial government. Members of the provincial government must be eligible for the Landtag (provincial diet) but need not be members of it. The following posts are incompatible with the office of member of the provincial government: Federal President, president or vice-president of the Court of Audit, president, vice-president or member of the Oberster Gerichtshof, of the Constitutional Court and of the Administrative Court. Members of provincial government are answerable to the Landtag, which can bring charges against them at the Constitutional Court for culpable violation of the law. Legal status as member of the provincial government ends if s/he is found guilty by the Constitutional Court, also as a consequence of specific convictions, when a new provincial government takes office, on the death of the member and, according to most provincial constitutions, with the resignation of the member or a vote of no-confidence against him/her by the Landtag. Decisions in the provincial government are taken by majority vote. The provincial constitution can also provide that individual members of the provincial government are put in charge of specific tasks of the provincial administration, except for matters which are reserved to the Landeshauptmann or the provincial government as a body under the federal constitution (e.g. the right of the provincial government to appeal against federal laws at the Constitutional Court). The administrative authority of the provincial government is the Office of the Provincial Government.
