Contractual Civil Servants, persons employed with federal, provincial or municipal communities or authorities whose employment is based on a contract under private law and not, like that of civil servants, created through a unilateral act of the sovereign authority. They handle not only private-sector administration but are increasingly entrusted with duties of public administration. Legal basis is the 1948 Contractual Civil Servants Act (Federal Law Gazette 86) for the federal administration and similar regulations at provincial level for contractual civil servants of provincial and municipal authorities. Unlike the employment of civil servants, which cannot be altered by means of agreements under private law, special agreements deviating from the rights and duties enshrined in the law may be concluded according to the Contractual Civil Servants Law.
