Personal Freedom, Protection of: The 1988 federal constitutional act on the protection of personal freedom replaced the act of 1862 and protects citizens from encroachment by the state. Deprivation of liberty is only justified in cases of (lawful) imprisonment, remand, coercive detention or provisional arrest of an extraditable offender and, under certain circumstances, in cases of infectious diseases or mental illness, or for educational purposes in the case of minors. Imprisonment can only be imposed by court or another independent authority. Nobody can be detained more than 24 hours without judicial order. Every arrested person is to be informed about the reasons for his/her arrest and has the right to contact a relative and a lawyer. Unlawfully detained people are entitled to damages.
